Terms & Conditions
Effective: October 1, 2025; 9am ET
By participating in the Sitewide Offer (“Program”), you are agreeing to these Sitewide Offer Terms & Conditions (these “Terms”), and you remain subject to the Faire Terms of Service located at www.faire.com/tos (the “Faire Terms”) and the Faire Privacy Policy located at www.faire.com/privacy. The Faire Terms (including the Retailer Terms of Service located at https://www.faire.com/tos-retailer (the “Retailer Terms”)) are incorporated herein by reference and apply to your participation in the Program. “Retailer,” and “you” or “your” refers to the retailer that accepts these Terms. In the event of a conflict between these Terms and the Faire Terms (including the Retailer Terms), the Faire Terms will govern and control. Capitalized terms not defined in these Terms have the meanings given in the Faire Terms.
Program Participation
Duration. The Challenge has a duration of 90 days, which commences from October 1, 2025 (9am ET) and ends on January 1, 2026 (3am ET) (“Program Period”).
Eligibility. The Program may not be available in every region or country or for every Retailer and Faire determines eligibility for the Program in its sole discretion. Currently, the Program is invite only and limited to North American Brands. If the Program is available to you, you will see it on the home page.
Spend Target. During the Program Period, you are expected to spend with Faire a custom amount set by Faire (“Spend Target”). Any discounts, promotions, returns, cancellations, credits from prior orders, taxes, shipping, and other fees do not count toward your Spend Target. You can find the amount of your Spend Target on the home page.
- Eligible Spend. Each dollar that you spend with Faire on confirmed brand orders during the Program Period will count towards the Spend Target, less any adjustments, including any discounts, promotions, returns, cancellations, credits from prior orders, taxes, shipping, and other fees (“Eligible Spend”). Preorders and Scheduled orders will count toward Eligible Spend only if they are both placed and also shipped during the Program Period. Note that purchases made during Faire Markets (“Market Spend”) will apply toward the Spend Target but will not be included in Eligible Spend for the purposes of earning credit. Adjustments for any purchased goods must be requested within the Return Eligibility Period (defined in Section 8 of the Retailer Terms) and subject to the Retailer Terms. Faire has the discretion to disqualify any amount of the Eligible Spend towards the Spend Target, at any time during the Program Period, as a result of any actual or suspected misuse or abuse of the services under the Program.
- Overages. You will receive Program Credits (defined below) for any Eligible Spend that exceeds the Spend Target during the Program Period (“Overages”).
Tracking. In connection with the Program, Faire may provide you with updates with respect to your progress toward your Spend Target via email or the Faire platform. For the avoidance of doubt, it is your responsibility to monitor your progress towards the Spend Target during the Program Period without reference to or reliance upon information provided by Faire. Faire makes no representations or warranties regarding the accuracy or completeness of any data or information made available and shall have no liability for any claims or actions related to its provision of data or information as part of Grow with Faire.
Program Benefits
Faire Credits. If you meet the Spend Target during the Program Period, you will earn five percent (5%) of your total Eligible Spend, which does not include any Market Spend, back in program credits (“Program Credits”) to spend at Faire toward future orders. Program Credits, when earned in accordance with these Terms, will be deposited into your Faire account within forty five (45) business days after the end of the Program Period. All Program Credits are non-transferable, have no intrinsic value, and cannot be redeemed for cash. The Program Credits do not expire so long as you have a Faire account (and otherwise as set forth in these Terms). Program Credits may be combined with other discounts and credits when placing orders on Faire unless otherwise communicated to you by Faire.
Loss of Benefits. If you do not meet the Spend Target during the Program Period, you will not receive Program Credits for any Eligible Spend. Any purchases you return after the Program Period ends will not count toward your Eligible Spend and will be excluded from any Program Credit you may receive. Notwithstanding the above, you will not incur any penalties or losses if you do not meet the Spend Target and there will be no change with respect to your status as a Retailer using Faire.
Program Integrity. In the event of any actual or suspected misuse or abuse of the services or violation of these Terms, Faire has the discretion, at any time, to disqualify any order amounts from the Eligible Spend, revoke or claw back any issued Program Credits and/or suspend or terminate any Retailer’s participation in the Program. If you return purchases included in Eligible Spend after the end of the Program Period, Faire reserves the right to revoke or claw back any Program Credits delivered to you based on those purchases.
Term; Termination. These Terms will remain in effect for as long as the Program continues to operate. After the Program Period, Faire may terminate, suspend, or discontinue these Terms without advanced notice, for any reason and without prior notice to you. Faire also reserves the right to suspend or terminate your participation in the Program as reasonably determined by Faire in its sole discretion. You may withdraw your participation from the Program at any time. Upon any termination, suspension, or discontinuation of these Terms or your participation in the Program, you may no longer access and/or use any of the services provided by the Program except that previously-issued Program Credits will remain available for use toward future orders (provided you were not suspended from the Program based on a Program Integrity as described above).
Modification. Faire may modify these Terms or the Program, for any reason, upon thirty (30) days’ notice. If Faire modifies these Terms, Faire may post the modifications on its Site and/or provide you with notice of the modifications. Your continued participation in the Program constitutes implied acceptance of any modifications of the Terms. If any modifications to the Terms are not acceptable to you, your only recourse is to withdraw your participation from the Program.
